TERMS OF SERVICE Version: terms-2026-08-07 Effective date: August 7, 2026 Operator: Fuxin Brain Kingdom AI Technology R&D Co., Ltd. Please read these Terms carefully before registering for or using the Service. The Service includes AI-generated content, voice cloning, digital avatars, long-term memory, audio/video processing, and paid features. AI-generated friends, responses, voices, and avatars are synthetic and are not real persons. Outputs may be inaccurate and are not medical, mental-health, legal, financial, or other professional advice. 1. Agreement. By checking the consent box, creating an account, signing in, or using the Service, you agree to these Terms and the Privacy Policy. If you act for an organization, you confirm that you are authorized to bind it. 2. Service. The Service may provide text chat, voice and video calls, speech recognition and synthesis, voice cloning, friend creation, memory import and analysis, proactive interactions, paid packages, and other released functions. We may modify, suspend, or discontinue functions for legal, security, technical, third-party, or operational reasons, subject to mandatory notice requirements. 3. Accounts and age. Registration information must be accurate and lawful. You are responsible for safeguarding passwords and verification codes. The Service is available only to users who are at least 18 years old and have legal capacity to use it. A higher minimum age applies where local law requires it. 4. Your content and authorization. Text, images, photographs, videos, voices, recordings, chat histories, relationship information, and other materials you provide are “User Content.” You must own or have documented permission for all User Content, including consent to process any other person's face, voice, likeness, communications, personal data, and intellectual property. You grant us a non-exclusive, service-limited license to store, transform, analyze, transmit, display, and process User Content, including through bound processors, only as needed to provide and secure the Service. Ownership is not transferred. 5. Prohibited impersonation. You may not clone or use another person's face, voice, voiceprint, likeness, private communications, or digital identity without clear authorization. You may not use the Service for fraud, impersonation, deception, harassment, defamation, unlawful surveillance, privacy violations, infringement, or illegal or harmful content. 6. Memory. If you import chats, recordings, or videos, the Service may transcribe, summarize, label, embed, and connect them into long-term memory. Do not upload third-party sensitive information, confidential communications, or trade secrets without authority. Available controls may allow you to review, correct, and delete memories, subject to legally required retention and reasonable backup deletion periods. 7. Payments and packages. The purchase screen controls the package type, applicable function, text-message quota, voice/video minutes, price, currency, validity, and restrictions. Different quotas are generally not interchangeable. Payments may be processed by Paddle, PayPal, or another enabled provider and are also subject to that provider's terms. We will investigate platform-caused non-delivery, duplicate charges, or clear billing errors and provide correction, quota restoration, or a refund where required. Nothing in these Terms excludes mandatory consumer rights. 8. Acceptable use. You may not violate law, public safety, or third-party rights; upload illegal, exploitative, hateful, sexually abusive, violent, self-harm-promoting, or child-harming content; attack or reverse engineer the Service; abuse verification or payment systems; scrape data; or use unreviewed outputs for high-impact medical, legal, employment, credit, insurance, or similar decisions. 9. Moderation and enforcement. We may use automated and human review to protect users and the Service. We may reject processing, preserve evidence, remove content, limit functions, suspend or close accounts, and report conduct when reasonably necessary or legally required. Rights holders may submit a notice through our published support channel. 10. Third-party services. We may rely on AI, speech, avatar, hosting, storage, moderation, payment, email, SMS, verification, analytics, and delivery providers. Their availability and independent services are governed by their terms. We select and contractually restrict processors where required, but cannot unconditionally guarantee services outside our reasonable control. 11. Intellectual property. The application, interface, marks, documentation, and our original materials are protected by law. Rights in User Content remain with the relevant owner. Rights in AI output depend on applicable law, provider terms, and the legality of inputs; output may not be unique or protectable. 12. Availability and liability. We use reasonable efforts to maintain the Service but do not promise uninterrupted, error-free, or fit-for-every-purpose operation. To the extent permitted by law, we are not liable for indirect or unforeseeable losses. This limitation does not apply to liability that cannot lawfully be excluded, including liability arising from intentional misconduct or gross negligence where applicable. 13. Termination. You may request account closure through available settings or support. We may warn, limit, suspend, or terminate access for breach, security risk, inactivity, or legal requirements, and will provide available appeal channels where appropriate. 14. Changes. We may update these Terms and will provide reasonable notice of material changes. Where required, we will ask you to consent again. If you do not accept a material change, you may stop using the Service and close your account. 15. Governing law and contact. These Terms are governed by the laws of the People's Republic of China, without displacing mandatory consumer protections in your place of residence.
